If you have satisfactorily completed the probationary portion of your sentence for a misdemeanor or felony DUI conviction, or have been granted an early discharge from probation, you may qualify for an expungement of your criminal record in the matter.

How could you benefit from a dui expungement?

1. The case at hand will result in a dismissal

2. You will not need to disclose your charges and conviction on job applications, with the exception of government jobs requiring a government issued license, certificate or permit, or a job which involves a security clearance, in which case the conviction will be uncovered.

3. If the DUI conviction was charged as a felony,an expungement is the first step in pursuing a Pardon from the Governor of California.


What a DUI Expungement will NOT do is:

1. Remove the conviction from your “Rap Sheet” - California and FBI criminal history records will still show the conviction and a dismissal “per PC 1203.4";

2. Reinstate the individual's right to possess firearms, if the DUI resulted in a felony coviction.

3. Allow the expungee to omit the conviction from from government issued licenses applications;

4. Seal or otherwise remove the court case file from public inspection - an individual or agency skilled in background investigations and record inspection will be able to find the court case file, although your probation report remains confidential and is open to public inspection for only the first 90 days after your initial sentencing.

5. Prevent the DUI violation from being used as a “prior” DUI conviction to increase penalties in the event you receive another DUI arrest within ten years of the date of your expunged DUI arrest.

6. Exclude the DUI conviction from impeachment purposes if called as a witness in a court of law;

7. Exclude the conviction from consideration in refusal or revocation of a government license or teaching credential, security guard certificate, permit, nursing license, bus drivers license, special clearance, etc., although licensing and certifying agencies typically give less weight to a convictionthat has since been expunged than one that has not.

8. Exclude the DUI conviction as a consideration for immigration or amnesty.
